AGB

1. Eligibility and Consumer Status

Users must be at least 18 years old and legally capable of entering a binding contract. These Terms are designed primarily for consumers purchasing for personal use in Germany. A business purchaser should contact us before ordering if business-specific terms are required.

2. Website Information

We take reasonable care in presenting products, prices and availability, but minor errors may occur. Product images are illustrative. Colours and proportions can differ due to screens, photography and room settings. Natural materials can vary. Measurements are approximate unless expressly stated otherwise, and customers must assess dimensions, access and suitability before ordering.

3. Prices and Payment

Prices shown at checkout are the prices applicable to the order and include applicable taxes where the website states that they are included. Standard delivery is free under our Shipping Policy. Any optional charge will be shown before the order is submitted. Payment must be authorised using an accepted method. We may use third parties to process payments and conduct fraud or security checks.

4. Order Process and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean acceptance. We may accept the order by sending an express acceptance or dispatch confirmation. A contract is formed only when acceptance occurs. Each dispatched item may form a separate contract where an order is fulfilled in parts.

We may decline or cancel an order before acceptance because of stock unavailability, a pricing or description error, payment failure, suspected fraud, delivery restrictions or legal requirements. If payment has been taken for an order we do not accept, it will be refunded.

5. Availability and Substitutions

All products are subject to availability. We will not substitute a materially different product without the customer's agreement. If an item becomes unavailable, we may cancel the affected item and refund it, or contact the customer with available options.

6. Delivery

Delivery is governed by the Shipping and Delivery Policy. The stated estimate is 15–20 calendar days unless a different estimate is shown and agreed at checkout. Dates are estimates rather than guaranteed appointments unless expressly confirmed as such. We remain responsible for the goods until they come into the physical possession of the customer or a person identified by the customer, except where the customer independently appoints a carrier not offered by us.

7. Customer Delivery Responsibilities

Provide a complete and accurate address and contact details.

Check that the route to the delivery location is safe and sufficiently large.

Ensure an authorised adult is available where attendance is required.

Follow carrier instructions and promptly report visible package damage.

Do not ask delivery personnel to perform installation, assembly or handling outside the confirmed service.

If delivery fails because information is incorrect, access is unsafe or the customer does not attend an agreed appointment, reasonable redelivery or return costs may be charged where lawful and clearly communicated.

8. Inspection, Assembly and Installation

Customers should inspect goods, parts and instructions before assembly or installation. Do not assemble or install an item that is visibly damaged, materially incorrect or unsuitable. Furniture must be assembled according to instructions and secured to a wall where anti-tip guidance requires it. Wall fixings must be suitable for the wall type.

Electrical products must be used only with compatible supplies and fittings. Fixed-wiring work should be completed by a suitably qualified electrician. We are not responsible for damage caused by improper installation, incompatible components, unauthorised modification, misuse or failure to follow instructions, except to the extent responsibility cannot lawfully be excluded.

9. Returns, Cancellation and Faulty Goods

Returns and refunds are governed by our Return and Refund Policy. Consumers in Germany normally have a statutory right to withdraw from most online purchases within 14 days after delivery, subject to exceptions, and our voluntary policy permits eligible requests within 30 days. Faulty, misdescribed or non-conforming goods are subject to the statutory warranty rights under the German Civil Code (BGB).

10. Promotions and Discount Codes

Promotions may have additional terms, eligibility criteria and expiry dates. Unless stated otherwise, promotions cannot be combined, exchanged for cash or applied retrospectively. We may withdraw a promotion before an order is accepted, but will honour a valid promotion already incorporated into an accepted contract.

11. Reviews and User Content

A user who submits a review, photograph or other content confirms that it is lawful, accurate to the best of their knowledge, and does not infringe another person's rights. The user grants us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store. We may moderate or remove unlawful, irrelevant, abusive or misleading content.

12. Intellectual Property

The website's text, layout, graphics, logos and other content are owned by or licensed to the website operator and are protected by intellectual-property law. Personal, non-commercial browsing is permitted. Reproduction, scraping, republication, resale or commercial exploitation without permission is prohibited, except where law permits otherwise.

13. Acceptable Use

Do not interfere with the website, security controls or another user's account.

Do not introduce malicious code or use automated tools in a manner that damages or overloads the service.

Do not use the website for fraud, unlawful activity or infringement.

Do not provide false payment, identity, age or delivery information.

14. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any other liability that cannot lawfully be excluded. We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses suffered by a consumer using products for commercial purposes, to the extent permitted by law.

15. Events Beyond Reasonable Control

We are not liable for delay caused by events beyond reasonable control, but will take reasonable steps to reduce the effect, communicate material delays and perform our obligations when possible. If a delay becomes substantial, the customer may have cancellation rights under the contract or applicable law.

16. Changes, Severability and Waiver

We may update these Terms for future website use and future orders. The terms applying to an accepted order are normally those in force when the order was submitted, unless a change is required by law or agreed with the customer. If a provision is invalid or unenforceable, the remaining provisions continue. Delay in enforcing a right is not a waiver.

17. Governing Law and Disputes

These Terms and consumer contracts are governed by German law, without depriving consumers resident elsewhere in the European Union of mandatory protections that apply under conflict-of-law rules, without depriving the customer of mandatory protections. Consumers may bring proceedings in the courts that have jurisdiction under applicable law. We encourage customers to contact us first so that we can try to resolve concerns promptly and fairly.

18. Contact

For questions, complaints or notices relating to these Terms, contact info@thecarsonhouse.shop. Include the order number where the matter concerns a purchase.
